In this webinar, Maura Clancy, Robert Chisholm and Zachary Stolz will discuss the applicable standards for filing writs of mandamus based on VA’s unreasonable delay before the U.S. Court of Appeals for Veterans Claims (CAVC).  They will address the recent decision by the U.S. Court of Appeals for the Federal Circuit (Federal Circuit) in Martin v. O’Rourke, which adopted the six-factor TRAC standard.  In addition to reviewing relevant case law, Maura, Robert and Zachary will explore important practical considerations when deciding if a writ should be filed.   

Robert and Zachary are partners at Chisholm Chisholm & Kilpatrick in Providence, Rhode Island, where they represent veterans and their dependents before the Federal Circuit, CAVC, and VA.  Robert is a past president of both the CAVC Bar Association and NOVA.  In 2016, the CAVC awarded the Hart T. Mankin Distinguished Service Award to Robert in recognition of his 25 years of outstanding service to the court.  He has served as appellant’s lead counsel in over 7,500 cases before the CAVC.

Before joining the firm, Zachary worked in the Judicial Appeals Office of the Disabled American Veterans (DAV) from 2005 to 2007.  A past president of the CAVC Bar Association, he serves on the NOVA Board of Directors and previously served on the Federal Circuit Bar Association’s Veterans Appeals Committee.  He has handled over 3,000 veterans’ cases before the Federal Circuit, CAVC, and Board of Veterans’ Appeals. 

Maura Clancy joined Chisholm Chisholm & Kilpatrick in 2016 as an associate attorney.  She has worked on both the Agency team and the Court team.  She is a member of the Massachusetts and Rhode Island State Bars, the U.S. District Court for the District of Rhode Island, and the United States Court of Appeals for Veterans’ Claims.  She also serves as a member of the Board for the Federal Bar Association’s Veterans and Military Law Section.  Maura’s practice focuses on representing disabled veterans before the CAVC, and she is also accredited to represent veterans and their families before VA’s Regional Offices and the Board of Veterans’ Appeals.
